Even an article on the far-left-leaning NBC News website notes that "the disputed email was sent to Smith the DAY AFTER [emphasis mine] her complaint was filed and reported on in the media".
Unless she can time travel, it would seem impossible that she "based her complaint" on an email she had not yet received.
Additionally, the article notes that the "'sham' client was [not] a relevant factor in the court's decision because it isn't even mentioned in the majority opinion or the DISSENT [emphasis mine]".
